1. Scope and seller
These Terms and Conditions apply to all orders placed by private customers through the online shop at deviem.ch.

2. Offers and formation of the contract
The presentation of products in the online shop does not constitute a legally binding offer. It is an invitation to place an order.
Before submitting an order, customers can review and correct the products they have selected and the information they have entered. By clicking the final order button, the customer places a binding order.
The purchase contract is formed when Deviem confirms the order by email or dispatches the goods ordered. An order may be declined before acceptance, particularly if a product is unavailable, payment cannot be authorised, or there is an obvious pricing or product error.
3. Products and product presentation
The essential characteristics of each product are set out in its product description. Customers are responsible for reviewing the product description, materials, measurements and care instructions before placing an order.
Colours and details may differ slightly from the actual product depending on the screen used. Jewellery made by hand or from natural materials may show slight variations in colour, shape or texture. Such minor variations arising from the materials or manufacturing process do not constitute a defect, provided the product does not differ materially from the agreed characteristics or its product description.
4. Prices, taxes and shipping costs
The prices displayed in the online shop at the time of the order, in the selected currency, apply. Any applicable value added tax is included to the extent that it is charged.
Shipping costs are displayed at checkout before the order is completed. The available shipping methods, costs and estimated delivery times are also set out in the Shipping Policy.
International deliveries may be subject to import duties, taxes or other charges in the destination country. Unless these amounts are expressly displayed and collected at checkout, they are not included in the purchase price or shipping costs and must be paid by the recipient.
5. Payment
The payment methods shown at checkout are available for the relevant order. Payment is generally due when the order is completed.
Payments may be processed by external payment service providers. Their additional terms and privacy policies may also apply.
Deviem is not required to dispatch an order until payment has been successfully authorised or received.
6. Delivery
Delivery is available only to the countries and regions shown as delivery destinations at checkout. Orders are generally shipped by Swiss Post or DHL.
Delivery times are estimates. Delays caused by shipping providers, customs authorities, force majeure or other circumstances beyond Deviem’s reasonable control cannot be ruled out entirely. Mandatory statutory rights in the event of late delivery remain unaffected.
In consumer contracts, the risk of loss of or damage to the goods generally passes only when they are handed over to the customer or a person designated by the customer and authorised to receive them, unless mandatory law provides otherwise.
7. Retention of title
The goods delivered remain Deviem’s property until payment has been made in full, to the extent permitted by applicable law.
8. Cancellation and voluntary returns
Deviem offers a voluntary return period of 15 calendar days from receipt of the goods. The requirements, exceptions, return shipping costs and return procedure are described in the Cancellation and Refund Policy.
For consumers habitually resident in the European Union, the statutory right of withdrawal applies during the first 14 days in accordance with the cancellation information. On the 15th day, the conditions of the voluntary return policy apply.
Mandatory statutory rights relating to cancellation, returns, legal guarantees and defects remain unaffected in all cases.
9. Defects and legal guarantees
Customers are asked to inspect the goods after delivery and to notify Deviem as soon as possible of any apparent defects, damage in transit or incorrect items, quoting the order number. A delay in reporting does not limit any mandatory statutory rights.
Where a defect is established, the rights and remedies relating to defects and legal guarantees under applicable law apply. Depending on the applicable law and the circumstances, these may include repair, replacement, a price reduction or a refund.
Damage caused exclusively by improper use, failure to follow care instructions, external factors or ordinary wear and tear is not considered a defect present in the original product. Mandatory statutory rights remain unaffected.
10. Liability
Deviem is liable in accordance with mandatory legal provisions. In particular, no limitation of liability applies in cases of intentional misconduct or gross negligence, injury to life, body or health, product liability, or any other case in which liability cannot legally be excluded or limited.
To the extent permitted by law, Deviem is not liable for damage caused exclusively by improper use of the products, failure to follow care instructions or circumstances beyond Deviem’s reasonable control.
11. Intellectual property
The content of the online shop, including texts, photographs, graphics, product images, logos and designs, is protected by copyright or other intellectual property rights. Any use, reproduction or distribution beyond what is permitted by law requires the prior consent of the relevant rights holders.
12. Privacy
Information about the collection and processing of personal data is provided in Deviem’s Privacy Policy.
13. Governing law and jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the country in which they are habitually resident.
Disputes are subject to the courts having jurisdiction under applicable law. These Terms and Conditions do not establish an exclusive place of jurisdiction in relation to consumers.
14. Changes and final provisions
Deviem may amend these Terms and Conditions for future orders where legal, technical or operational developments make this necessary. Contracts already concluded remain subject to the version accepted when the order was placed.
If a provision of these Terms and Conditions is invalid or unenforceable, the remaining provisions remain unaffected. The applicable statutory provisions take the place of the invalid provision.
